Last updated: August 28, 2026
Version 1.2

This is a courtesy English translation provided for convenience. The original French version (cgu.html) is the legally binding text; in case of any discrepancy between the two versions, the French version prevails.

⚠️ Access to this application is strictly reserved for adults (18 years of age or older). The consumption of alcohol is prohibited for minors. By registering, you certify that you have reached the legal drinking age in your country of residence.

Article 1 – Presentation of the application and the publisher

1.1 The application

La Belle Bière (hereinafter "the Application") is a community mobile application available on the iOS and Android platforms. It allows its users to discover, rate, and share their beer experiences: publishing photos and reviews of beers consumed, discovering establishments (bars, breweries), viewing community rankings, and social interaction between members.

The Application is accessible free of charge, with no subscription or in-app purchase.

The Application is neither a sales website, a delivery service, nor a commercial intermediary for alcoholic beverages. It does not enable the purchase, ordering, or delivery of alcohol, and has no commercial relationship with producers, distributors, or establishments selling alcohol. Its purpose is exclusively social and community-based: sharing experiences, reviews, and discoveries between private individuals.

1.2 The publisher

The Application is published and operated by:

Gaspard Vancompernolle
Private individual – operating in a personal capacity
Contact email: contact@labellebiere.com

Hereinafter referred to as "the Publisher".

Article 2 – Acceptance of the Terms of Use

Use of the Application implies full and unconditional acceptance of these Terms of Use (hereinafter "the Terms"). This acceptance is confirmed by checking the corresponding box when registering for the Application.

Any person who refuses to accept these Terms must refrain from using the Application.

These Terms constitute the contract binding the Publisher to each user. In the event of a conflict between specific conditions applicable to certain services and these Terms, the specific conditions shall prevail.

Each user's acceptance of the Terms is individually timestamped and retained by the Publisher, to ensure proof and traceability. Any user whose account was created before this mechanism was put in place, or who has not yet accepted the Terms for any other reason, is presented with a mandatory acceptance screen the next time they connect to the Application; failing acceptance, access to the Application is refused, in accordance with the second paragraph of this article.

Article 3 – Access conditions and legal age

3.1 Minimum age requirement

Access to the Application is strictly reserved for individuals who are at least 18 years old at the date of registration. Pursuant to French regulations on the protection of minors and the "Loi Évin" (Law No. 91-32 of January 10, 1991), the Application deals with alcoholic beverages and may not be used by minors.

By creating an account, the user declares on their honor that they are 18 years of age or older. The Publisher reserves the right to suspend or delete without notice any account demonstrated or strongly suspected to belong to a minor.

The Publisher declines all liability in the event of a false declaration of age by a user.

3.2 Legal capacity

The user declares that they have full legal capacity to enter into these Terms. Any use of the Application by a person lacking the legal capacity to enter into a contract is carried out under the sole responsibility of that person's legal guardian.

3.3 Geographic area

The Application is primarily intended for users residing in mainland France. The Publisher does not guarantee the suitability of the content or features, nor compliance with local regulations, for users located outside of France. Use of the Application from abroad is done under the sole responsibility of the user, who must ensure compliance with applicable local law.

Article 4 – Registration and management of the user account

4.1 Account creation

Full use of the Application requires creating a personal account. Users may register via:

The user agrees to provide accurate, complete, and up-to-date information. Any registration made with false or fraudulent information may result in the immediate suspension or deletion of the account.

4.2 Login credentials

The account is personal, non-transferable, and non-assignable. The user is solely responsible for keeping their login credentials confidential. Any use of the account with the user's credentials is presumed to have been carried out by the user themselves. In the event of the account being compromised or used fraudulently, the user must inform the Publisher without delay at the contact address indicated in Article 1.

The Publisher cannot be held liable for any damage resulting from the fraudulent use of a user's account by a third party, provided the user did not report the compromise in a timely manner.

4.3 One account per person

Each user may hold only one active account. Creating multiple accounts by the same person is prohibited.

4.4 Account deletion

The user may delete their account at any time from the Application's settings. Deleting the account results in the permanent deletion of the associated data (posts, photos, profile data), in accordance with the Privacy Policy.

The Publisher reserves the right to delete any account inactive for more than 24 months, following prior notification to the email address associated with the account.

Article 5 – Description of services

The Application offers, free of charge, the following services:

Beer profiles serve an exclusively documentary and informational purpose. They constitute neither advertising, nor a recommendation to consume, nor an incentive to consume an alcoholic beverage. The average rating shown on a profile ("community score") is the simple automatic aggregation of users' personal, subjective ratings: it does not originate from the Publisher, expresses no value judgment on its part, and does not constitute a commercial ranking.

The Publisher reserves the right to modify, suspend, or discontinue all or part of the services at any time, without notice, and without this giving rise to any compensation.

Article 6 – User-generated content

6.1 Definition

Any content published by a user within the Application (photos, text, comments, reviews, ratings, establishment information, beer profiles and profile corrections, content created following a barcode scan, etc.) is referred to as "User Content". Beer profiles and profile corrections created by a user fall entirely under this Article 6, including with respect to any inaccurate factual data they may contain.

6.2 Sole responsibility of the user

The user is solely and fully responsible for the User Content they publish. By publishing content, the user guarantees:

The Publisher does not exercise systematic control over User Content prior to publication and cannot be held liable for it. The Publisher acts as a hosting provider within the meaning of Article 6 of the French Law for Confidence in the Digital Economy (LCEN, Law No. 2004-575 of June 21, 2004).

6.3 License granted to the Publisher

By publishing User Content, the user grants the Publisher a worldwide, non-exclusive, royalty-free license, for the duration of applicable legal protection, to use, reproduce, display, distribute, and adapt this content as part of the operation and promotion of the Application. This license ends when the content is deleted by the user or when the user's account is deleted.

6.4 Reviews and ratings

Reviews and ratings published on the Application are the personal and subjective opinions of their authors. They are binding only on those authors and do not, under any circumstances, constitute an official recommendation from the Publisher. The Publisher declines all liability regarding the accuracy, reliability, or relevance of published reviews.

Article 7 – Rules of conduct and prohibited behavior

The user agrees to use the Application in a lawful and respectful manner. The following are strictly prohibited:

7.1 Illegal or inappropriate content

7.2 Abusive behavior

7.3 Technical abuse

Any breach of these rules may result in the immediate suspension or deletion of the account, without notice or compensation, and without prejudice to any legal proceedings.

Article 8 – The "Loi Évin", responsible consumption, and exclusion of liability

8.1 Applicable legal framework

The Application deals with alcoholic beverages for informational and community purposes. Pursuant to French Law No. 91-32 of January 10, 1991 on the fight against smoking and alcoholism (known as the "Loi Évin"), codified notably in articles L.3323-2 to L.3323-6 of the French Public Health Code, the Publisher reminds users that:

The user agrees not to use the Application to commercially promote alcoholic beverages, not to publish content associating alcohol consumption with driving, sports, pregnancy, or any other situation prohibited by applicable regulations, and not to directly or indirectly encourage excessive, rapid, or dangerous alcohol consumption.

8.2 Exclusion of liability regarding alcohol consumption

The user is solely and entirely responsible for their alcohol consumption, the quantity consumed, the pace of their consumption, and any and all consequences, direct or indirect, resulting therefrom for their own health or safety or that of others (accidents, illness, behavioral issues, bodily or material damage, etc.).

The Application does not sell, serve, provide, or deliver any alcoholic beverage. It exercises no control over the establishments, products, or quantities actually consumed by its users. The Publisher expressly declines all liability, of any kind whatsoever, regarding the consequences of alcohol consumption by a user, whether or not such consumption is related to use of the Application, to the consultation of a beer profile, a ranking, an event, a personal statistic, or a discovery suggestion.

By checking the box accepting these Terms, the user acknowledges having read this article and expressly commits to consuming alcohol responsibly and in moderation, in accordance with applicable health recommendations.

8.3 Community and gamified features

The Application may offer community features with a gamified element (rankings, challenges, notifications encouraging quick sharing of an experience, counters or countdowns, etc.). These features relate exclusively to the act of posting, rating, or sharing content within the Application, and do not in any way constitute an incentive to consume alcohol more quickly, in larger quantities, or within a constrained time frame. The user remains free to participate in these features or not, and remains the sole judge of the pace and quantity of their consumption, independently of any incentive, countdown, or gamification mechanic offered by the Application.

The Application offers a points and tiers system that rewards user activity within the Application (posting content, taking part in community features). These points and tiers are purely symbolic: they have no monetary value, cannot be bought, sold, exchanged, or converted, and give no entitlement to any reward, prize, discount, benefit, or gain of any kind. They involve no element of chance and do not constitute a prize competition or lottery. The Publisher may at any time change the scoring, reset counters, or remove this feature, without the user being able to claim any vested right.

Article 9 – Liability of the Publisher

9.1 General limitation of liability

The Application is provided "as is" and "as available", without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, the Publisher excludes all warranties of merchantability, fitness for a particular purpose, and non-infringement.

The Publisher cannot be held liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use the Application, even if it has been advised of the possibility of such damages.

9.2 Third-party and user content

The Publisher is not responsible for User Content published on the Application. It acts as a technical hosting provider within the meaning of the LCEN and cannot be held liable for content published by users, unless it has been notified of such content and has failed to act promptly to remove it.

To report illegal content, users may use the reporting feature built into the Application or contact the Publisher at the address indicated in Article 1.

9.3 Information about establishments

Information relating to establishments (bars, breweries) displayed on the Application is provided by users or by the establishments themselves. The Publisher does not verify the accuracy of this information (hours, prices, addresses, beer availability, etc.) and declines all liability in the event of errors, omissions, or outdated information. This information is provided for informational purposes only.

9.4 Information about beers

Beer profiles (brewing location, style, alcohol content, taste characteristics, description) are filled in by the Publisher or by users, based on public sources. They are provided "as is", for informational purposes only, without any warranty of accuracy, completeness, or currency, and may contain errors or have become outdated (change of recipe, vintage, or labeling). They are in no way a substitute for the official information shown on the product packaging. The taste indicators (bitterness, acidity, fruitiness, intensity, etc.) are subjective tasting cues and do not constitute a composition analysis.

Users must not rely on beer profiles for any decision relating to their health or safety (actual alcohol content, allergens, gluten, additives, fitness for consumption, etc.). The Publisher declines all liability in the event of errors, omissions, or outdated information in a beer profile.

9.5 Availability and continuity of service

The Publisher does not guarantee uninterrupted availability of the Application. Interruptions may occur due to maintenance, technical failures, incidents at third-party providers (in particular Supabase, Apple, Google), or any other event beyond the Publisher's control. The Publisher cannot be held liable for damages resulting from the unavailability, even prolonged, of the Application.

9.6 Data loss

Despite the measures in place, the Publisher does not guarantee the permanent retention of data and content published by users. Users are encouraged to keep a copy of their important content. The Publisher declines all liability in the event of data loss resulting from a technical failure, a cyberattack, or the deletion of the account.

9.7 Third-party links and services

The Application may refer to third-party establishments, brands, or services. The Publisher has no commercial relationship with these third parties and is not responsible for their practices, content, or services. Any dispute with an establishment or brand is a matter for the direct relationship between the user and that third party.

Article 10 – Liability of users

The user is solely responsible for:

The user agrees to indemnify the Publisher against any claim, legal action, damage, or expense (including attorneys' fees) resulting from their breach of these Terms or of applicable regulations.

Article 11 – Information about establishments

La Belle Bière allows users and establishments themselves to provide information about bars and breweries (address, hours, prices, available beers, etc.).

The Publisher draws users' attention to the following points:

The Publisher declines all liability in the event of travel undertaken or decisions made based on inaccurate information displayed in the Application.

Article 12 – Moderation and sanctions

12.1 Reporting

Any user may report content or behavior they believe violates these Terms via the reporting feature built into the Application. The Publisher undertakes to review reports within a reasonable time.

12.2 Powers of the Publisher

In the event of a proven or suspected violation of these Terms, the Publisher reserves the right, without notice or compensation, to:

These measures may be taken without any obligation to provide prior justification. A sanctioned user may send a dispute to the Publisher at the address indicated in Article 1.

12.3 Blocking between users

The Application has a blocking feature that allows a user to block another user. The Publisher is not responsible for disputes arising between users and invites them to resolve their disputes amicably or to make use of the blocking and reporting features.

Article 13 – Intellectual property

13.1 Rights of the Publisher

The Application, its interface, design, features, architecture, source code, logos, icons, and any other element making up the Application (with the exception of User Content) are the exclusive property of the Publisher or are subject to licenses granted to the Publisher.

Any unauthorized reproduction, representation, modification, adaptation, translation, extraction, or exploitation of these elements is strictly prohibited and constitutes an infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.

13.2 Beer brand rights

The beer brand names mentioned in the Application (Heineken, Guinness, Stella Artois, etc.) are the property of their respective owners. The Publisher has no commercial relationship or partnership with these brands. Their mention in the Application is purely for reference and community purposes.

13.3 Users' rights over their content

The user retains all of their intellectual property rights over the User Content they publish. The license granted to the Publisher under Article 6.3 does not constitute a transfer of ownership.

Article 14 – Protection of personal data

The Publisher collects and processes personal data in connection with the use of the Application, in accordance with the General Data Protection Regulation (GDPR – EU Regulation 2016/679) and the amended French Data Protection Act ("Loi Informatique et Libertés").

The terms of collection, use, retention, and protection of personal data, as well as users' rights (access, rectification, deletion, portability, objection), are detailed in the Application's Privacy Policy, accessible at any time from the Application and at: https://gaspardleboss.github.io/LBB/confidentialite-en.html.

The Privacy Policy forms an integral part of these Terms.

Article 15 – Data hosting

The Application's data is hosted by Supabase (Supabase Inc.), on servers located in Ireland (European Union). This hosting within the European Union ensures that your data benefits from the level of protection provided by the GDPR, without transfer to third countries.

Photos and media published by users are stored on Supabase's storage service, subject to the same guarantees.

The Publisher cannot be held liable for failures, incidents, or conduct of Supabase as a third-party hosting provider, beyond the reasonable security measures put in place.

Article 16 – Third-party services and APIs

The Application uses third-party services whose terms of use are independent of these Terms:

The Publisher reserves the right to modify, replace, or remove these third-party integrations at any time, without notice.

Article 17 – Push notifications

The Application may send push notifications to the user's device (new rating, new comment, new follower, etc.). Users may disable these notifications at any time from their device's settings or from the Application's settings. Disabling notifications does not affect access to the Application's features.

The Publisher cannot be held responsible for notifications not received, or received late, due to a failure of Apple's notification services (APNs) or any other technical constraint.

Article 18 – Amendment of the Terms

The Publisher reserves the right to amend these Terms at any time. Amendments will be notified to active users via a notification within the Application and/or by email, at least 15 days before they take effect, except in cases of urgency or a legal obligation requiring an immediate change.

Continued use of the Application after the new Terms take effect constitutes acceptance of them. If a user refuses the new Terms, they must stop using the Application and may delete their account.

The version of the Terms in force is accessible at any time from the Application and is identified by its update date.

Article 19 – Governing law and dispute resolution

19.1 Governing law

These Terms are governed by French law. In the event of translation into other languages, the French version shall prevail.

19.2 Amicable resolution

In the event of a dispute relating to the Application or these Terms, users are invited to first contact the Publisher at the address indicated in Article 1, in order to seek an amicable solution.

19.3 Consumer mediation

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, should amicable resolution fail, the Publisher will offer recourse to a consumer mediator. The contact details of the competent mediator will be provided to the user upon request to the Publisher.

19.4 Competent jurisdiction

Failing an amicable resolution, any dispute relating to the validity, interpretation, or performance of these Terms shall be submitted to the exclusive jurisdiction of the competent French courts. For disputes with consumers, the competent court will be that of the consumer's place of residence or one of the courts designated by applicable civil procedure rules.

Article 20 – Miscellaneous

20.1 Severability

If any clause of these Terms is declared null or unenforceable by a competent court, the other clauses shall remain in full force and effect.

20.2 No waiver

The fact that the Publisher does not enforce a user's breach of an obligation under these Terms shall not be interpreted as a waiver of the right to enforce that breach, or a similar breach, at a later date.

20.3 Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between the Publisher and the user. They supersede any prior communication, proposal, or agreement, whether oral or written.

Article 21 – Contact

For any question, complaint, or request relating to these Terms, you may contact the Publisher:

The Publisher undertakes to respond to any request within a reasonable time, and at the latest within 30 days of receipt.
